    Fiosnet Ltd does not guarantee that the integrity of this website has been maintained. Fiosnet Ltd makes the information in this website available without warranty express or implied that the website and the servers on which it is hosted are free of viruses or other harmful components. Fiosnet Ltd will not accept liability for any damage or loss whatsoever that may occur as a result of accessing this website.

    If any provisions of these terms and conditions are found to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then the validity of any remaining part(s) shall remain unaffected and in full force and effect as though the illegal, invalid or otherwise unenforceable parts had not existed.

    These terms shall be governed by and interpreted in accordance with the laws of Ireland.

  2. Amendments

    Fiosnet reserves the right to amend these terms from time to time. By continuing to use the site after changes have been made you agree to be legally bound by these terms as amended.

  3. Disclaimer Specific to the Menukit Extension package

    Fiosnet makes no claim regarding the suitability of this software for any purpose. The software is provided "as is" and "with all faults" without any express or implied warranty and without any guarantee of technical support of any kind. Fiosnet makes this software available on a "Try before you Buy" basis. It is your responsibility to try out the software and satisfy yourself that it meets your requirements before you buy it. By installing this Menukit Extension you indicate your acceptance of these terms and conditions and you affirm that neither you nor any third party shall make any claims against Fiosnet for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, interruption of business, loss of data or profits, whether in contract, negligence or other tortious action, arising from or in connection with the use of this software.

  4. Menukit License Types

    1. Evaluation License

      The trial software is being made available for evaluation purposes only. The trial software must not be used in the making of any production website whether commercial or non-commercial. No component parts of the downloaded software, including JavaScript scripts, CSS stylesheets, HTML code, XML code, native code or example menus may be used in the making of production websites.

      Only the DHTML menus are enabled in the trial; the CSS menus are disabled.
      The trial download comes with an evaluation license that is valid for 14 days after first use. The trial software restricts the number of menu items to 14; this is sufficient to allow all the exercises in the tutorials to be completed.     2. Personal License

      This type of licence is available only to individual persons who are developing a website for personal, non-commercial use. Organisations and institutions, including educational institutions, government bodies and businesses are not eligible for a personal license. Non-commercial means that you do not expect to get compensated in any way for any menu that you develop using Menukit. Neither may you use Menukit to develop a menu for any person or entity that would not qualify for a non-commercial license.

    3. Professional License

      A professional license is required if the purchaser does not qualify for a Personal license.

  5. Authorised Use of Menukit

    A Menukit license entitles the licensee to use the Menukit Extension on a single computer. The license is issued only to the original purchaser of the Menukit software and may not be re-assigned to another party. The copyright and title to all intellectual property rights of this software, including its documentation and tutorials, remain with Fiosnet Ltd.

    A professional license permits the licensee to distribute menus created with Menukit to third parties and to charge for them without having to pay any royalties to Fiosnet Ltd. There is no limit on the number of end users to whom the menus may be distributed.

  6. Terms Specific to the Tutorials

    The tutorials on the website are made available on an "as is" and "as available" basis. Fiosnet Ltd makes no claim whatsoever either express or implied as to the quality of the tutorials including the methods, practices and techniques contained therein nor to their suitability for any purpose.

    You are permitted to use the tutorials in a classroom setting but you may not copy or re-distribute the tutorials in any form. You may provide links to the tutorials from your own pages provided the links are to the tutorial pages proper and not to a component within a page.

    A person who visits a tutorial page on the http://www.menukit.com website may print a hardcopy of the tutorial for his or her own personal use.

  7. Try Before You Buy

    Although Menukit is a very powerful tool for creating menus, a website developer still requires a working knowledge of Dreamweaver, HTML and CSS in order to make proper and effective use of it.

    You must decide for yourself if Menukit is a suitable tool for you. To help you decide if Menukit meets your particular needs, Fiosnet Ltd makes this software available on a 'Try Before You Buy' basis so that you can try it out to see if it is suitable for you. The trial version of the Menukit software includes an evaluation license that allows the software to be used, for evaluation purposes only, for 14 days after installation. If you do not buy a license when the trial period expires then you must delete all components of the software from your system and from any other systems or servers on which it has been deployed.

  8. Refund Policy

    If you take advantage of our flexible 'Try Before You Buy' offer then you should never have any reason to request a refund. Nevertheless, we will consider refund requests on an individual basis. All such requests, stating clearly the grounds on which it is made, must be submitted within 14 days of purchase.

    In order to defray the refund processing costs, an administration charge of $30 will be deducted from any refund granted and you must permanently delete the Menukit license and all copies of the Menukit software from your system.

  9. Any use of the Menukit software and tutorial material not covered by the above requires the prior written consent of Fiosnet Ltd.
